The guardianship authority - FAQ
The guardianship authority supports the guardianship court in the context of guardianship proceedings. It draws up a social report and, if necessary, suggests a guardian. In addition, it provides advice and support on care law issues and arranges alternative assistance.
1 What are the requirements for setting up legal guardianship?
If an adult is legally incapable of managing all or part of his or her affairs due to illness or disability, the guardianship court will appoint a legal guardian for him or her.
2. how do I become a legal guardian (voluntary/professional)?
The suitability of a volunteer guardian is assessed by the guardianship authority in accordance with Section 21 of the BtOG. The registration requirements for a professional guardian are set out in Section 23 of the BtOG.
3. how do I create a power of attorney?
A power of attorney can be completed using a standard form (reference: Federal Ministry of Justice) or informally. When drawing up the power of attorney, the principal must have legal capacity. The principal and the agent must provide their addresses, the place and date, and their signatures.
4 Where can I have my power of attorney notarized?
The power of attorney can be certified by a local government office or the citizen service center (reference).
The costs (monthly flat rate for the guardian) for legal guardianship only have to be borne by the person concerned if their assets exceed €10,000. If their assets exceed €25,000, the annual court costs and the costs of expert opinions (e.g., medical reports) are also charged to the person concerned.
