If you are a foreign national and are subject to a residence requirement for a specific location, you can have this residence requirement lifted or changed under certain conditions if you wish to move to another state. To do so, you must submit a corresponding application to the relevant immigration authority.

The requirements may also be met by a family member of the applicant.

Persons entitled to asylum, refugees, or persons recognized as needing subsidiary protection

• Employment subject to social insurance contributions (at least 15 hours per week and a net income of at least €820.00 (as of April 2022)) or an income that secures a livelihood
• Training or study place
• The persons married to you, your registered civil partner, or the minor child to whom you are related and with whom you live or have lived as a family lives at a different place of residence
• Avoidance of hardship (e.g., humanitarian reasons)

Other humanitarian reasons

• If you wish to apply for a change or waiver of the residence requirement for your residence permit, you must first submit an application to your local immigration office.
• Please discuss in advance which documents you need to include with your application.
• The immigration authority will review your application and usually ask the immigration authority at your new place of residence for their approval.
• Once the review is complete, you will receive a corresponding notification.

• A personal interview is required.
• You may only move after you have received approval from your previous immigration authority. Therefore, please refrain from moving until you have received this approval.

Fictitious approval

If the immigration authorities at the new place of residence do not respond to the request from the immigration authorities at the current place of residence within four weeks, approval is automatically granted and the applicant is permitted to move.
