Purposes and legal basis of the processing of personal data
As the data subject, we inform you that you have the right to obtain information about the data stored about you in accordance with Art. 15 GDPR, the right to rectify inaccurate personal data in accordance with Art. 16 GDPR, the right to erasure of your personal data in accordance with Art. 17 GDPR, the right to restriction of processing in accordance with Art. 18 GDPR, a right to data portability if the requirements of Art. 20 GDPR are met, and in the cases of Art. 21 (1) and (2) GDPR, a right to object to processing.
If data processing is based on your consent, you have the right to revoke this consent at any time in accordance with Art. 6 para. 1 lit. A or Art. 9 para. 2 lit. a GDPR, without affecting the lawfulness of the processing carried out on the basis of the consent until revocation.
Furthermore, you have the option of complaining to the competent supervisory authority about the processing of your personal data.
Legal basis
The authorities responsible for enforcing the Residence Act may collect personal data for the purpose of enforcing this Act and provisions relating to foreign nationals in other Acts, insofar as this is necessary for the performance of their duties (Section 86 of the Residence Act). This data is transmitted to the registration authority (BAMF) and entered into the Central Register of Foreign Nationals (AZR) (Section 6 AZRG).
Additional legal bases are:
- the Act on the Central Register of Foreigners (AZRG) and the implementing regulation (AZRG-DV) thereto
- the Act on the General Freedom of Movement of Union Citizens (FreizügG/EU)
- the Asylum Procedure Act (AsylVfG)
- the Federal Central Register Act (BZRG)
- the Employment Ordinance (BeschV)
- The Integration Ordinance (IntV)
The deletion periods are based on Section 91 of the Residence Act (AufenthG) in conjunction with Section 68 of the Residence Ordinance (AufenthV). The data is
- deleted (automatically) after 10 years if the person moves abroad.
- deleted after 5 years (automatically) upon the death of the foreigner or after naturalization
- deleted 10 years after the expiry of the entry and residence ban (§ 11 (2) AufenthG) following expulsion, return, or deportation (automatically).
Right of appeal
