Data processing and your rights in the case of official guardianship/guardianship by the city administration of Mainz

What are the purposes and legal basis of data processing?
If a family court appoints the youth welfare office as official guardian/official custodian or if the youth welfare office has become the guardian/custodian of the minor concerned by virtue of the law, it thus exercises parental authority in whole or in part.
In order to fulfill these tasks, it is necessary to process the personal data of the minor and the parents concerned.
Your data will be collected on the basis of Art. 6 (1) (c) GDPR in conjunction with Sections 61 (2) and
68 SGB VIII (Social Security Code VIII) and §§1773 ff. or 1909 ff. BGB (German Civil Code). However, data processing may also take place on the basis of a declaration of consent (Art. 6 (1) (a) GDPR).
What data is collected and processed?
We process the following personal data from you to the extent necessary in individual cases to fulfill our tasks:
- Personal data (name, address, marital status, date of birth, place of birth, nationality, foreigner status if applicable)
- Communication data (telephone/mobile number, email address)
- Case-specific data (family court decision on the (partial) withdrawal of custody, information on other children, spouse/partner, if applicable, occupation/employer/school, if applicable, income and financial circumstances (insofar as relevant to the minor's social security or maintenance claims), health insurance data (insofar as relevant to the minor's insurance status and benefits), account data, social security data, attending physicians, membership in associations, etc.)
If we need to collect further information about your personal and financial circumstances in order to fulfill our duties as official guardian/trustee, we will inform you accordingly.
Where do we collect your data and to whom is your data passed on?
We collect your data or pass it on to the following bodies (only if this is necessary in individual cases to fulfill our tasks):
- Courts and police (in connection with family court cases, guardianship matters, asylum proceedings, criminal cases, if applicable)
- Authorities (e.g., registration office, immigration office)
- Service providers within the framework of social legislation (social security and social insurance agencies, pension insurance agencies, family benefits offices, social services, inpatient/outpatient youth welfare facilities, foster families, elementary education, health insurance companies)
- Schools and training centers
- Healthcare institutions (doctors, therapists, hospitals).
To which bodies will your data be passed on?
Your personal data will only be passed on to the following parties if this is necessary in individual cases in order to fulfill tasks:
- Family court
- Social security and social insurance agencies (e.g., job center, social welfare office, economic
- youth welfare services, family benefits office, Bavarian Center for Family and Social Affairs, German Pension Insurance, federal government, health insurance fund)
- Social services (e.g., in the social services center, Office for Housing and Migration)
- Foreigners' registration office
Your data will only be passed on if and to the extent that this is necessary for the City Youth Welfare Office to fulfill its duties as guardian or caregiver.
How long will your data be stored by us?
Due to the long-term significance of the data, especially for the minor concerned, the files are stored by the state capital of Mainz for 30 years from the beginning of the following year after the minor reaches the age of majority.
After that, the files will be destroyed in accordance with data protection regulations and the data will be deleted.
What rights do you have?
According to the General Data Protection Regulation, you have the following rights:
- If your personal data is processed, you have the right to obtain information about the data stored about you (Art. 15 GDPR).
- If incorrect personal data is processed, you have the right to have it corrected (Art. 16 GDPR).
- If the legal requirements are met, you can request the deletion or restriction of processing
- and to object to the processing (Articles 17, 18, and 21 GDPR).
If you exercise your above-mentioned rights, the public authority will check whether the legal requirements for this are met.
You also have the right to lodge a complaint with the Rhineland-Palatinate State Commissioner for Data Protection and Freedom of Information.
