Data processing and your rights when taking and publishing photos

Information from the City of Mainz in accordance with Art. 13 of the General Data Protection Regulation.

Photos may also constitute personal data and, unless otherwise specified below, are taken and processed in the course of our public duties (Art. 6(1)(e), (2) and (3) GDPR in conjunction with § 3 LDSG). If you have consented to data processing, the data processing is based on Art. 6 (1) (a) GDPR.

Purpose and categories of data that we process

The state capital of Mainz produces a large number of photos and film recordings for the purposes of citizen information, public relations, press work, and tourism. This purpose supports the public interest in providing information (including images) about our activities to the extent necessary to fulfill our obligation to provide comprehensive information to citizens and the general public. The photo and, where applicable, film data and thus your personal data will generally be stored for an unlimited period of time, unless otherwise agreed or regulated, as we also want to take historical interest into account by permanently documenting our activities.

Photos may be published on the website, on social media channels, in print media, and in other digital media to showcase the activities of the state capital of Mainz.

If we wish to honor and highlight individuals, personal data (first and last name) will be collected and processed in addition to the photos and film recordings.

If photos or film recordings provide information about ethnic origin, religion, or health (e.g., skin color, head covering, glasses), we will also process this information.

No obligation to provide personal data

You are not required to allow us to photograph and/or film you or to provide us with your first and last name. If you do not wish to be photographed, please inform the photographer immediately. If you do not wish to be photographed but notice that a camera is pointed in your direction, please turn away. If the state capital of Mainz plans to take photos and film at municipal events, it will provide advance notice of this in invitation flyers and on notices posted at the event venue.

Processing photographs of children and young people

We will only publish photographs of children and young people with the consent of their parents. This also applies to group photos. In the case of separated or divorced parents with joint custody, the consent of both parents is required. Only in the case of sole custody is the consent of that parent sufficient. As an exception, consent is not required if the photo shows an event where the focus is on the event itself (e.g., summer party, St. Martin's parade, open house, band festival at the HdJ, Girls' Day, holiday card) and not on individual persons.

The daycare center or youth center is not responsible if parents take photos or videos without the consent of the persons concerned and publish them on social networks. The facility may, within the scope of its domiciliary rights, issue a general ban on photo and video recordings or stipulate that only photos may be taken by authorized daycare center staff or photographers officially commissioned by the city administration of Mainz.

The form of consent is governed by Art. 7 GDPR and may also be given verbally (cf. Recital 32 to Art. 7 GDPR).

Young people aged 16 and over may give their consent themselves.

Commissioning of photographers

The rights and obligations within the framework of a contract awarded by the state capital of Mainz to photographers are regulated by contract in each case.
The transfer of data from photographers to the state capital is carried out via secure communication channels.

Passing on photographs

The state capital of Mainz will only pass on photographs and film recordings to third parties for the purposes specified below and unless otherwise agreed and regulated. The transfer is carried out exclusively for the purpose of advertising Mainz (catalogues, press coverage, PR articles, citizen information). The transfer is contractually regulated with the photographers when the order is placed (see section "Placing orders with photographers").

When the state capital of Mainz publishes photos and film recordings on social media channels, the data is transferred there and also processed by the operators of the social media platforms. Transfer of data to a third country or to an international organization

Our data processing takes place in Germany and in the EU; data is not transferred to a third country or an international organization. However, photos and videos may be transferred to a third country outside the EU if they are published on a social media channel and the operator of the social media platform is based outside the EU.

Objection to the processing

However, it can be assumed that the interest of the state capital of Mainz in the production and use of the photos does not unduly interfere with the rights and freedoms of the natural persons concerned, natural persons, especially since they have entered the public space, the production and use of the photos was pointed out in advance and at the event, and care is taken both when taking photos and when publishing them to ensure that no legitimate interests of the persons depicted are violated.

If, for particularly compelling reasons, the rights and freedoms of a person depicted are violated, we will refrain from further processing by taking appropriate measures. It is not possible to blur images in print media that have already been published. Deletion from the website or social media channels will be carried out within the scope of technical and organizational possibilities.

If you exercise your above-mentioned rights, we will check whether the legal requirements for this are met and you will receive a corresponding notification from us. We may ask you to identify yourself. We are obliged to do so in case of doubt, especially when transmitting emails that have not been provided with a qualified digital signature.
